    EPF and MP act, 1952

    The Employees' Provident Fund & MP Act,1952 is an important piece of Labour Welfare legislation enacted by the Parliament to provide social security benefits to the workers .
     

    New Company Registration


    • Filing of necessary papers and obtaining PF registration code number for new
    establishment within prescribed time as per Act.
    • Form 5A (Return of ownership)
    • Form 9 (Revised)
    • Submission of Specimen Signature

     

    Monthly Process


    • Preparation of monthly Callahan for EPF & deposited into bank within prescribed time as per Act.
    • Prepare Monthly Return :
    o Form 12A (Revised)
    o Form -5 (New Joinees)
    o Form-10 (Resigned)
    • Preparation of Form- 7(IF)
    • PF Eligibility Register
    • Maintenance of all statutory registers required by the PF authorities.
    • Preparation of Monthly PF Ledger.
    • Nomination & Declaration Forms in Form No. 2 (Revised) of the new employees
    • Declaration form in Form- 11(Revised)
    • Attend PF inspector for inspection of records, appearing before the concerned
    authorities on behalf of the employer in 7-A proceedings under EPF Act.
    • All assessment & inspection from EPF department, when required.
    • Information with regard to any amendment/changes in the act will be informed
    immediately.

     

    Annual Process


    • Form No. 3-A (Monthly Contribution of the employees)
    • Form No. 6-A (Annual Return)
    • Bank Reconciliation
    • "DBF" Database File in soft copy
    • Assist in issuance of Annual PF A/c slips.

     

    PF Withdrawals & Transfers

     

    • Receipt of forms (19 & 10-C) after 30 days of leaving of the employee making
    settlement.
    • Receipt of PF transfer forms (Form 13) from new appointees and sending them to
    RPFC/Ex-Employers trust for getting the fund transferred through the concerned RPFC
    office.
    • Taking care the process of PF withdrawals and Transfer within prescribed time as per
    Act.
    • Scrutiny of papers to ensure that same are within the norms as specified under the
    rules.
    • Acknowledging the transferred received.
    • Visiting the PF offices as and when required
    • Advising on coverage of International workmen
    • Advising on coverage of contractors workmen

     

    Enactments...
    Applicability
    This enactment is compulsorily applicable if 20 or more employees (including
    contractor’s) are employed and activities are falling under scheduled I. Option is also
    available for voluntary coverage, if majority of employees and employer agrees for the
    coverage.

     

    Consequences

     

    • Employee’s salary (Basic + DA) rate is below Rs. 15000/- pm
    • Remains to be covered, Opted to be covered even rate is above Rs. 15000/- pm
    • Coverage of disabled an international workmen u/p 82 & 83 respectively.

    Employees' State Insurance Act, 1948

    The Employees' State Insurance Act, 1948 is one of the most prominent social security legislation in India. It has been enacted to provide certain benefits like medical, sickness, maternity and employment injury benefits to employees. The Act is administered by the Employees' State Insurance Corporation, the premier social security organization in India.

     

    ESI Applicability

     

    The Employees' State Insurance Act, 1948 extends to whole of India;It applies to all
    factories / establishments running with the aid of power and employing 10 or more
    persons and to those factories which run without the aid of power and employing 20 or more persons;

     

    ESI Eligibility

     

    Employees drawing salary / wages not exceeding Rs. 15,000/- per month are covered
    under the provisions of ESI Act.

    Factory act,1948

    The Factories Act, is a social legislation which has been enacted for occupational safety, health and welfare of workers at work places. This legislation is being enforced by technical officers i.e. Inspectors of Factories, Dy. Chief Inspectors of Factories who work under the control of the Chief Inspector of Factories and overall control of the Labor Commissioner, Government of National Capital Territory of Delhi.This enactment deals with the Industrial Safety, Health & Welfare of the workmen in the manufacturing activities. It also includes monitoring of proper working conditions, working hours,
    medical checkup, leave, use of safety instruments, testing of pressure vessels, providing creche facilities, safety officers, rest room, canteens etc.

     

    • Preparation and approval of factory building and machinery layout.
    • Assessing the fees payable and obtaining the Callahan.
    • Preparation of application for factory license and renewals.
    • Verifying and auditing of maintenance records.
    • Preparation and submission of annual return.
    • Obtaining stability certificate.

     

    APPLICABILITY

     

    It applies to factories covered under the Factories Act, 1948. The industries in which ten (10) or more than ten workers are employed on any day of the proceeding twelve months and are engaged in manufacturing.

     

    Process being carried out with the aid of power or twenty or more than twenty workers are employed in manufacturing process being carried out without the aid of power.

    Minimum wage act, 1948

    This act provides for fixing minimum rates of wages in certain employment. Government of National Capital Territory of Delhi has already notified rates of Minimum Wages in 29 scheduled employments. However DA based on CPIM is released time in your (Feb/Aug) to compensate the week inflate rate.

    Payment Of Bonus Act, 1965

    A small tagline

    The Payment of Bonus Act imposes statutory liability upon the employers of every establishment covered under the Act to pay bonus to their employees. It further provides for payment of minimum and maximum bonus and linking the payment of bonus with the production and productivity. The Act applies to every factory where 10 or more workers are working and every other establishment in which 20 or more persons are employed, on any day during an accounting year.

     

    • Employee is entitled for bonus provided worked for minimum 30 days and rate of salary
    (Basic + DA) is below Rs. 10,000/- pm in a financial year
    • Assessing the applicability of the enactment
    • Preparation of Form no. A and B, which is based on Income Tax and Balance Sheet
    • Advising on payment of bonus and its disbursements - Form no. C

    Contract Labour Act, 1970

    Payment of Gratuity Act,1972

    A small tagline

    Act provides for the payment of gratuity to workers employed in every factory, shop &
    establishments or educational institution employing 10 or More persons on any day of the preceding 12 months. A shop or establishment to which the Act has become applicable shall continue to be governed by the Act even if the number of persons employed falls bellows 10 at any subsequent Stage. All the employees irrespective of status or salary are entitled to the Payment of gratuity on completion of 5 years of service. In case of death or Disablement there is no minimum eligibility period. The amount of gratuity payable shall be at the rate of 17 days wages based on the rate of wages last drawn, for every completed year of service. The maximum amount of gratuity payable is Rs. 10, 00, 00/-.in 2009.

     

    Formula: Last Wages *15*No. of services/26
    Nomination
    Each employee is required to nominate one or more member of his family, as defined in the
    Act, who will receive the gratuity in the event of the death of the employee.
